“Customer”, “you”, or “your” means the person, company, merchant, agency, or organization using Presenter3D or requesting services from us.

“Experience” means an interactive 3D product experience, demo, configurator, presentation, showroom, guided scenario, or related hosted viewer created, hosted, or powered by Presenter3D.

“Viewer” means the web-based Presenter3D runtime used to display an Experience.

“Dashboard” means the private management interface used to manage projects, variants, languages, analytics, commerce settings, orders, or other supported features.

“Commerce engine” means Presenter3D’s optional commerce infrastructure for configurable products, including supported features such as pricing logic, stock logic, reservations, order records, invoices, returns, customer emails, and related workflows.

“Brand” means a self-contained commerce setup within Presenter3D, with its own pricing, stock, tax rules, sending (email) identity, and order history. A single Brand may cover multiple e-shops, URLs, and regions that share the same inventory and order identity.

“Experience Management” means Presenter3D’s optional dashboard tools for managing supported parts of an Experience after launch, including variants, labels, languages, voiceovers, analytics, and other supported editable data.

“Analytics PLUS” means Presenter3D’s optional enhanced analytics subscription, including full session recording and playback and aggregate interaction reporting across sessions.

“Sync API (application programming interface)” means Presenter3D’s application programming interface used to connect an Experience to a Customer’s existing store, checkout, product data, stock data, price data, or custom systems.

“Customer Content” means all files, data, text, images, 3D models, product information, prices, stock information, tax settings, shipping settings, business rules, logos, brand assets, uploaded content, or other materials provided by you or entered into Presenter3D by you or on your behalf.

“Third-Party Services” means external services, platforms, gateways, providers, or tools connected to or used with Presenter3D, including payment gateways, tax services, shipping services, email providers, hosting providers, analytics tools, e-commerce platforms, or custom systems.

02Scope of the service

Presenter3D provides a combination of studio services and software services.

Depending on your project scope and subscriptions, Presenter3D may provide:

  • interactive 3D experience production,
  • 3D modeling, optimization, and animation,
  • scenario design and interaction logic,
  • viewer hosting,
  • embedding and integration support,
  • Experience Management tools,
  • analytics and session playback features,
  • Commerce engine features,
  • Sync API access,
  • dashboard access,
  • commerce and product configuration logic,
  • technical support related to Presenter3D services.

The exact scope of any custom studio work is defined in a separate quote, proposal, invoice, or written agreement. If there is a conflict between these Terms and a signed written agreement, the signed written agreement controls for that specific project.

From time to time, we may offer features, tools, or integrations that are labeled “Beta”, “Preview”, “Early Access”, or similar. These features are provided for evaluation and testing purposes and may be incomplete, changed, or discontinued without notice. They are not considered part of the core production service and may be subject to additional terms. Your use of any Beta feature is at your own risk.

03Business use

Presenter3D is primarily intended for businesses, merchants, studios, agencies, and professional users.

If you use Presenter3D on behalf of a company or organization, you confirm that you have authority to bind that company or organization to these Terms.

If applicable consumer protection laws give you rights that cannot legally be excluded, those rights remain unaffected.

04Project quotes and studio work

Custom production work is scoped per project. A quote may include, depending on the project, 3D modeling, optimization, animation, scenario design, commerce logic setup, hosting setup, integration support, revisions, or other agreed services.

Work begins only after the scope, pricing, and payment terms are accepted.

Unless otherwise agreed in writing:

  • project timelines are estimates,
  • changes outside the agreed scope may require a new quote,
  • additional revision rounds may be billed separately, unless included in the quoted scope,
  • delays caused by missing Customer Content, late feedback, incorrect information, or third-party delays may affect delivery timing,
  • we are not responsible for delays caused by third-party platforms, gateways, providers, or services.

Unless otherwise agreed in writing, production fees for a project are invoiced in stages against the accepted estimate:

  • 25% on acceptance of the quote; work begins on receipt of this payment,
  • 25% on delivery of the first version for your review,
  • 25% on delivery of the pre-final version for your review,
  • the remaining balance on final delivery, including any agreed integration work.

At the first-version and pre-final review stages, you may request changes, improvements, or additional features. Where requested changes fall outside the then-current accepted scope, we may issue a revised estimate. Work on the revised scope begins once you accept the revised estimate, which then becomes the total project price. Amounts already invoiced are credited toward the revised total, and the final balance equals the accepted total project price less all amounts already paid.

Where 3D modeling, optimization, rigging, or animation is included in the project scope, the resulting model file(s) are part of your deliverables and are released to you on final delivery and full payment, as described in Section 6.

05Customer Content and responsibilities

You are responsible for all Customer Content you provide, upload, enter, configure, or approve.

You confirm that you have all rights, licenses, permissions, and authority required to use the Customer Content with Presenter3D.

You are responsible for ensuring that Customer Content is accurate, lawful, complete, and suitable for your business use.

This includes responsibility for:

  • product descriptions,
  • product images,
  • 3D models and reference materials,
  • prices,
  • discounts,
  • stock levels,
  • stock keeping unit data,
  • availability rules,
  • regional settings,
  • language content,
  • voiceover scripts,
  • tax settings,
  • value-added tax settings,
  • business-to-business value-added tax settings,
  • shipping settings,
  • customs information,
  • return policies,
  • customer communications,
  • legal notices,
  • terms presented to your own buyers,
  • any data provided through the Sync API.

You agree not to provide or use Customer Content that infringes third-party rights, violates applicable law, is misleading, unsafe, fraudulent, harmful, or unlawful.

06Ownership and licenses

You keep ownership of Customer Content you provide to us.

Unless otherwise agreed in writing, we retain ownership of Presenter3D technology, software, viewer code, dashboard code, editor systems, templates, internal tools, workflows, methods, libraries, reusable components, and platform infrastructure.

For 3D modeling, optimization, rigging, or animation performed as part of a paid project, the resulting model file(s) — whether a new model we create, an optimized version of your existing model, or a rigged or animated version — are part of your deliverables. On full payment for the relevant project, you own these model deliverables, except that where a deliverable incorporates third-party or pre-existing licensed material, you instead receive a worldwide, perpetual, royalty-free license to use it. Your rights in the model deliverables include use outside Presenter3D, and we deliver these files together with the published Experience.

For clarity, your ownership of model deliverables does not transfer any rights in the Presenter3D platform, viewer runtime, scenario engine, scenario logic, hosting technology, or other Presenter3D components used to package, host, or run the Experience, which remain ours. If a project’s written agreement sets different ownership terms, those terms control for that project.

You grant us the rights needed to host, process, reproduce, display, modify, optimize, transmit, and use Customer Content as necessary to provide Presenter3D services, create the Experience, operate the Viewer, provide dashboard features, support integrations, and maintain the service.

Unless you ask us not to in writing, we may reference your project, brand name, screenshots, public Experience, or public results in our portfolio, case studies, marketing materials, or sales discussions, provided we do not disclose confidential non-public information.

07Hosting and availability

Presenter3D may host eligible Experiences under free or paid hosting conditions described on our website or in your project agreement.

Free hosting conditions may include technical limits such as file size, branding, access restrictions, storage rules, bandwidth assumptions, or other eligibility requirements.

We may update hosting limits, technical requirements, infrastructure, or delivery methods over time.

While we may change free-tier eligibility conditions, limits, and infrastructure over time, we will not introduce a recurring hosting fee as a condition of keeping an existing eligible Experience hosted without giving you reasonable prior notice and the opportunity to cancel. Free hosting is provided at no recurring charge for Experiences that meet the free-tier conditions.

We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free, or permanently available hosting. Service interruptions may occur due to maintenance, infrastructure providers, third-party services, network issues, security events, force majeure events, or technical failures.

We may suspend or restrict hosting, dashboard access, or Viewer access if:

  • payment is overdue,
  • the service is misused,
  • Customer Content is unlawful or harmful,
  • the project creates security, legal, or infrastructure risk,
  • required information is missing,
  • third-party providers restrict access,
  • you violate these Terms.

08Embedding and integration

Presenter3D Experiences may be embedded on websites or connected to external systems using supported methods such as iframe embeds, custom elements, Viewer parameters, the Sync API, or other integration tools.

You are responsible for your own website, store, checkout, hosting environment, front-end implementation, user interface, privacy notices, cookie notices, security, and compliance unless we explicitly agree in writing to handle a specific part of that work.

If we provide integration support, that support is limited to the agreed scope. We are not responsible for unrelated website issues, platform restrictions, theme conflicts, plugin conflicts, code written by third parties, or changes made by your team after delivery.

09Commerce engine

The Commerce engine is an optional tool that helps Customers run commerce workflows for configurable products.

The Commerce engine may support features such as:

  • pricing logic,
  • stock logic,
  • variant logic,
  • reservations,
  • checkout handoff,
  • order records,
  • invoices,
  • returns,
  • customer emails,
  • buyer profiles,
  • offers,
  • back-orders,
  • pre-orders,
  • regional settings,
  • tax configuration,
  • business-to-business value-added tax logic,
  • shipping profile data,
  • payment gateway connections,
  • third-party tax or shipping integrations.

Presenter3D is a software provider and integration layer. Presenter3D is not the seller of record for your products, unless explicitly agreed in writing.

You, as the merchant, remain solely responsible for your products, sales, buyers, legal obligations, and business operations.

You are responsible for:

  • the products you sell,
  • the legality and safety of your products,
  • product claims and descriptions,
  • pricing accuracy,
  • stock accuracy,
  • availability accuracy,
  • discounts and promotions,
  • order acceptance,
  • order fulfillment,
  • customer service,
  • returns and refunds,
  • warranty obligations,
  • consumer rights compliance,
  • tax settings,
  • value-added tax settings,
  • business-to-business value-added tax settings,
  • tax registration and reporting,
  • tax collection and remittance,
  • shipping rules,
  • shipping fees,
  • customs declarations,
  • import and export compliance,
  • commercial invoices,
  • incoterms,
  • duties and import taxes,
  • customer notices,
  • your own sales terms,
  • your own privacy obligations.

If the Commerce engine allows you to enter, import, or declare revenue, sales volume, transaction counts, marketplace sales, external sales channels, tax nexus information, value-added tax thresholds, registration status, or other business data from outside Presenter3D, you are solely responsible for the accuracy and completeness of that information.

Presenter3D may use this information to help display, organize, calculate, or route commerce workflows, but Presenter3D does not verify your external revenue, sales thresholds, nexus status, tax registrations, marketplace activity, or reporting obligations. You are responsible for determining whether sales made through Presenter3D, through other platforms, through marketplaces, or through offline channels create tax, value-added tax, customs, filing, registration, collection, remittance, or reporting obligations.

The Commerce engine may help calculate, display, store, or transfer commerce data based on information you provide or third-party data you connect. We do not guarantee that your tax, shipping, customs, value-added tax, duty, invoice, return, or regulatory settings are legally correct for your business.

Validation, autocomplete, carrier checks, payment checks, tax checks, or similar checks are support tools only and do not replace merchant review or professional advice.

You should consult qualified tax, customs, legal, accounting, or shipping professionals where needed.

10Payments and payment gateways

Presenter3D may connect to third-party payment gateways such as Stripe or other supported providers.

Payment processing is provided by the relevant payment gateway, not by Presenter3D.

You are responsible for creating, maintaining, and complying with your own payment gateway account and the gateway’s terms.

We are not responsible for:

  • payment gateway approval or rejection,
  • payment disputes,
  • chargebacks,
  • fraudulent payments,
  • payment delays,
  • payment holds,
  • gateway fees,
  • gateway downtime,
  • gateway restrictions,
  • gateway compliance requirements,
  • gateway account suspension,
  • errors caused by incorrect payment configuration.

If a payment gateway rejects, freezes, delays, refunds, disputes, or reverses a transaction, that issue is between you, the payment gateway, the buyer, and any relevant financial institution.

11Tax services and tax settings

Presenter3D may support manual tax settings or optional third-party tax integrations.

Any tax data, value-added tax handling, business-to-business value-added tax logic, reverse-charge logic, tax rate, tax exemption, invoice setting, or regional rule must be configured and verified by you.

Any revenue, threshold, tax nexus, value-added tax registration, marketplace, external channel, or sales-volume information entered into Presenter3D is provided by you and is not independently verified by Presenter3D.

Presenter3D does not provide tax, accounting, legal, or financial advice.

You are solely responsible for determining whether, where, and how taxes apply to your products and sales, including registration, calculation, collection, reporting, and remittance.

Third-party tax services may provide calculations or data, but you remain responsible for verifying that they are appropriate for your business.

12Shipping, customs, and fulfillment

Presenter3D may support shipping data, manual shipping settings, tracking numbers, shipping profiles, address collection, address autocomplete, address validation, or optional third-party shipping integrations.

Shipping, fulfillment, customs, and delivery remain your responsibility.

Presenter3D may collect recipient address information from buyers and may validate, autocomplete, or check address data using third-party services such as address validation providers, payment gateways, or shipping providers. These checks are provided to reduce errors and support the checkout and fulfillment flow, but they do not guarantee that an address is complete, deliverable, accepted by a carrier, legally sufficient for customs, or suitable for a specific shipment.

Buyers are responsible for the information they submit. You, as the merchant, remain responsible for reviewing, correcting where necessary, and using recipient and shipment data for fulfillment, customs, delivery, returns, customer support, and legal compliance. You are also responsible for any merchant-entered shipping data, shipment corrections, manual overrides, fulfillment decisions, and carrier instructions.

Third-party shipping services may help generate labels, rates, customs declarations, commercial invoices, or related shipping documents. These services rely on information provided by buyers, by you, by your connected systems, or by Presenter3D based on your configuration.

You are responsible for ensuring that all shipping and customs data used for fulfillment is accurate and complete, including:

  • product descriptions,
  • product values,
  • country of origin,
  • harmonized system codes,
  • weights and dimensions,
  • buyer-provided recipient data,
  • merchant-entered shipment data,
  • shipment corrections or overrides made before fulfillment,
  • sender data,
  • incoterms,
  • import duties,
  • taxes,
  • customs charges,
  • export restrictions,
  • carrier requirements,
  • delivery restrictions.

Presenter3D is not a carrier, freight forwarder, customs broker, tax advisor, or customs representative.

We are not responsible for customs delays, rejected shipments, incorrect customs declarations, duty assessments, import taxes, carrier errors, lost packages, damaged packages, delivery delays, return shipping costs, or penalties caused by incorrect or incomplete merchant data, buyer data, connected-system data, or third-party service output.

13Sync API and existing stores

If you use the Sync API to connect Presenter3D to an existing store, checkout, product database, inventory system, or custom backend, your connected system remains the source of truth unless otherwise agreed.

You are responsible for the accuracy, security, availability, and legality of data sent to or received from the Sync API.

We are not responsible for errors caused by:

  • incorrect Sync API implementation,
  • incorrect data mapping,
  • outdated store data,
  • third-party platform restrictions,
  • third-party platform downtime,
  • plugin conflicts,
  • custom code errors,
  • authentication failures,
  • rate limits,
  • network issues,
  • changes made by your team or third parties.

The Sync API is provided free of charge. There are no usage fees or per-transaction fees for the Sync API, and it remains free to use. We may change how the Sync API works over time, but it will not become a paid feature.

14Experience Management and analytics

Experience Management may allow you to edit supported data after launch, such as variants, labels, languages, voiceovers, supported scenario options, and analytics settings.

Not every part of an Experience can be edited safely from the Dashboard. Structural changes, new 3D objects, new animations, new scenarios, new interaction logic, or other complex changes may require new studio work and a separate quote.

Analytics and session playback tools, including the optional Analytics PLUS subscription, are provided for business insight and product improvement. Analytics may be approximate, incomplete, delayed, or affected by browser settings, user consent choices, ad blockers, technical errors, or privacy restrictions.

You are responsible for using analytics features in compliance with applicable privacy and data protection laws.

15Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and access permissions.

You are responsible for all activity under your account.

You must notify us promptly if you suspect unauthorized access, credential compromise, or security misuse.

We may suspend or restrict access if we believe an account is compromised, misused, or creates security risk.

16Acceptable use

You may not use Presenter3D to:

  • violate applicable law,
  • sell illegal, unsafe, counterfeit, stolen, or prohibited products,
  • infringe intellectual property rights,
  • mislead buyers,
  • process fraudulent orders,
  • distribute malware,
  • attempt unauthorized access,
  • reverse engineer the service,
  • scrape or overload the service,
  • bypass access controls,
  • remove Presenter3D branding where branding is required,
  • use the service to harm, harass, exploit, or deceive others,
  • interfere with the security, operation, or performance of Presenter3D.

We may suspend or terminate access if we believe your use creates legal, security, reputational, operational, or infrastructure risk.

17Prohibited or restricted products

You may not use Presenter3D or the Commerce engine to sell or promote products or services that are illegal, unsafe, or prohibited by applicable law or by our third-party providers.

Restricted categories may include, depending on jurisdiction and provider rules:

  • weapons,
  • explosives,
  • illegal drugs,
  • counterfeit goods,
  • stolen goods,
  • regulated medical products,
  • hazardous materials,
  • adult content or services,
  • gambling,
  • financial products requiring authorization,
  • sanctioned goods or services,
  • products violating export controls,
  • products that infringe third-party rights,
  • products requiring professional installation or certification where the customer cannot verify compliance.

We may refuse, suspend, or remove any project that we believe creates legal, regulatory, payment-provider, shipping-provider, or platform risk.

18Third-party services

Presenter3D may rely on or connect to Third-Party Services.

Third-Party Services are governed by their own terms, policies, fees, availability, and restrictions.

We are not responsible for Third-Party Services, including their performance, accuracy, downtime, security, pricing, policy changes, account decisions, or legal compliance.

If a Third-Party Service changes, suspends, removes, limits, or discontinues functionality, Presenter3D may be affected. We will try to adapt where commercially reasonable, but we do not guarantee that every third-party integration will remain available forever.

19Fees, subscriptions, and billing

Fees for custom production work are defined in the relevant quote, proposal, invoice, or written agreement.

Subscription fees for optional tools such as Experience Management, Analytics PLUS, Commerce engine, or other paid features are shown on the website, in the Dashboard, or in a written agreement.

Experience Management and Analytics PLUS are billed per Experience. The Commerce engine is billed per Brand. For billing purposes, an Experience generally corresponds to one managed interactive 3D model, and a Brand is a self-contained commerce setup as defined in Section 1.

Unless otherwise stated:

  • subscription fees are billed in advance,
  • yearly billing applies where stated,
  • you may cancel a subscription at any time; cancellation stops future renewal but does not automatically refund past or current billing periods,
  • fees are non-refundable except where required by law or expressly agreed in writing,
  • unpaid fees may result in suspension of paid features,
  • discounts, promotions, and volume pricing are subject to the terms published on our website at the time of purchase.

We may update pricing for future billing periods. If we change subscription pricing, we will provide reasonable notice where required.

20Cancellation and service changes

You may cancel optional subscriptions according to the cancellation method provided in the Dashboard or by contacting us.

If you cancel Experience Management, editing and analytics features may pause, but the Experience may remain hosted according to the applicable hosting conditions.

If you cancel the Commerce engine, commerce features may pause, but the Experience may remain hosted according to the applicable hosting conditions.

If all paid subscriptions are cancelled, the Experience may revert to the state and limits available under free hosting, if eligible.

We may modify, discontinue, or replace features over time. We will make reasonable efforts to avoid materially harming active paid projects, but we do not guarantee that every feature will remain unchanged permanently.

21Data and privacy

Our processing of personal data is described in our Privacy Policy.

You are responsible for your own privacy notices, cookie notices, buyer notices, legal bases, consent mechanisms, and data protection compliance for your own website, store, buyers, and connected systems.

If you use Presenter3D to process personal data on behalf of buyers, visitors, or end users, you are responsible for ensuring that your use complies with applicable privacy and data protection laws, including the General Data Protection Regulation where applicable.

If a separate data processing agreement is required, it must be agreed in writing.

22Confidentiality

If either party receives non-public business, technical, financial, or project information from the other, the receiving party must use reasonable care to protect it and must not disclose it except as needed to provide or use the services, comply with law, or enforce rights.

Confidentiality does not apply to information that is public, already known, independently developed, or lawfully received from another source.

23No guarantee of results

Presenter3D may help improve product presentation, engagement, configuration, or sales workflows, but we do not guarantee any specific commercial result.

We do not guarantee increased sales, conversion rates, search ranking, advertising performance, user engagement, reduced returns, or business revenue.

Any examples, demos, projections, or case studies are illustrative and not guaranteed outcomes.

24Anti-download and content protection

Presenter3D may use technical measures intended to reduce unauthorized downloading, copying, scraping, or reuse of hosted 3D assets.

No technical protection is absolute.

We do not guarantee that 3D models, textures, media, or other hosted assets cannot be copied, extracted, captured, downloaded, recorded, or misused by third parties.

You should not use Presenter3D as the only protection method for highly confidential, trade-secret, or extremely sensitive assets.

25Disclaimers

To the maximum extent permitted by law, Presenter3D is provided “as is” and “as available”.

We do not warrant that the service will be uninterrupted, error-free, secure, compatible with every browser or device, or suitable for every business purpose.

We do not warrant the legal, tax, accounting, customs, shipping, financial, or regulatory correctness of settings or outputs created from Customer Content, merchant configuration, buyer-provided information, connected-system data, or Third-Party Services.

Features labeled “Beta”, “Preview”, or “Early Access” are provided “as is” and “as available”, without any warranty of any kind, and may be discontinued at any time without liability.

26Limitation of liability

To the maximum extent permitted by law, Pixel-Park SRL will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of business, loss of goodwill, loss of data, business interruption, failed sales, lost orders, chargebacks, tax assessments, customs penalties, shipping losses, or third-party claims.

To the maximum extent permitted by law, our total liability for any claim related to Presenter3D will be limited to the total amount you paid to us for the affected service in the 12 months preceding the event giving rise to liability.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

27Indemnity

You agree to defend, indemnify, and hold harmless Pixel-Park SRL from claims, damages, losses, liabilities, costs, and expenses arising from:

  • your Customer Content,
  • your products,
  • your store,
  • your buyers,
  • your use of the Commerce engine,
  • your use of the Sync API,
  • your tax, shipping, customs, or payment configuration,
  • your external revenue, nexus, marketplace, threshold, or registration declarations,
  • buyer-provided recipient data used for fulfillment,
  • merchant-entered shipping data, corrections, overrides, or fulfillment decisions,
  • your violation of law,
  • your breach of these Terms,
  • your infringement of third-party rights,
  • claims by your customers or end users,
  • claims caused by data or settings supplied by you, your buyers, or your connected systems.

28Termination

We may suspend or terminate access to Presenter3D if you breach these Terms, fail to pay fees, misuse the service, create risk for us or third parties, or use the service unlawfully.

You may stop using Presenter3D at any time, subject to any active project agreement, subscription term, unpaid invoices, or cancellation rules.

Upon termination, we will provide you with a reasonable period (at least 30 days) to export your Customer Content, unless you have breached these Terms. After that period, we will delete or anonymize Customer Content, except where we are legally required to retain it.

29Changes to these Terms

We may update these Terms from time to time.

The latest version will be published on our website with an updated date.

If a change materially affects active paid services, we will provide reasonable notice where required.

Continued use of Presenter3D after changes take effect means you accept the updated Terms.

30Governing law and jurisdiction

These Terms are governed by the laws of Belgium, unless mandatory law requires otherwise.

Any dispute related to these Terms or Presenter3D will be submitted to the competent courts of Belgium, unless mandatory law requires another forum.

31General provisions

31.1 Entire Agreement. These Terms, together with any applicable quote, proposal, invoice, or written agreement, constitute the entire agreement between you and Presenter3D and supersede all prior negotiations, representations, or agreements.

31.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

31.3 Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

31.4 Force Majeure. Neither party will be liable for any failure or delay in performance caused by events beyond their reasonable control, including natural disasters, war, terrorism, strikes, supplier or infrastructure failures, internet outages, government actions, or malicious acts such as cyberattacks, distributed denial-of-service attacks, ransomware, or malware. For malicious acts, this relief applies provided that the affected party had implemented reasonable security measures. The affected party will promptly notify the other party of the disruption. Obligations to pay fees are not excused by force majeure.

31.5 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without your consent in connection with a merger, acquisition, or sale of substantially all assets.
